These Terms and Conditions apply only in Australia. By using this site, you swear and affirm that you are over the age of 18. Without exception, every person using the site or receiving a shipment of alcoholic beverages must be over the age of 18. www.nakedwines.com.au is operated by Naked Wines Australia Pty Ltd. Sale of wines through nakedwines.com.au is made under New South Wales liquor licence LIQP770016426.

THESE TERMS ARE AN ENFORCEABLE CONTRACT BETWEEN YOU AND NAKED WINES THAT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.

When you give Nakedwines.com your credit or debit card details, you are confirming that you are the card holder or have permission from the card holder to use the card on this website. For your own safety, we reserve the right to contact your card issuer for the purposes of carrying out security checks. If you add two or more credit cards to your Nakedwines.com account, and we are unable to charge your default credit card for an order you’ve placed, we will next attempt to charge the other credit card(s). By adding multiple credit cards to your Nakedwines.com account, you authorize this practice. Account registration data, as well as any personal or other information that you provide this site is governed by our Privacy Policy..

We reserve the right to cancel any orders we cannot fulfil for any reason. If your order is cancelled we will contact you to explain why and refund any money you have paid us for that order.

Nakedwines.com makes every effort to ensure that the information on this website is accurate and current. Nakedwines.com, however, provides this website and its contents on an "as is" basis and makes no, and expressly disclaims all, representations and warranties of any kind with respect to this website and its contents.

All of our wines are covered by our 100% hassle-free guarantee. We want you to enjoy the wines you buy from us - so, if you tell us a wine was faulty, or just not to your taste, we’ll add a credit to your account for you to put towards another order. This credit can only be used to buy products on our website and is not redeemable for cash. In the event we determine, in our sole discretion, that a customer is using this guarantee in a manner that is excessive or abusive, we reserve the right to revoke the guarantee for that customer with respect to future purchases.

Nakedwines.com's website may contain links to other websites or resources. You acknowledge and agree that Nakedwines.com is not responsible or liable for (1) the availability or accuracy of such websites or resources, or (2) the content, advertising, or products on or available from such websites or resources. The inclusion of any link on the Nakedwines.com website does not imply that Nakedwines.com endorses the linked site.

We reserve the right to suspend, terminate, or revoke access to your account at any time for legitimate business reasons, including where you breach these Terms and Conditions, misuse the service, or where required by law. Where reasonably practicable, we will provide you with notice of termination. However, we may suspend or terminate your account immediately and without notice where we reasonably believe this is necessary to protect our service, other users, or to comply with legal obligations.

All content displayed or comprising the website, including without limitation the images, brand names, trademarks, commentary, website layout and software are subject to intellectual property protection in Australia and internationally. You do not have permission to modify the content on this website, permit unauthorized users to access it (whether intentionally or otherwise) or transmit it to third parties. Any misuse of our intellectual property rights and/or our partners’ intellectual property rights will result in immediate termination of your account and you may be liable for damages.

We may update these terms from time to time to reflect changes in law, regulatory requirements, or how we operate our services. If we make a change that is material, we will provide you with reasonable advance notice, including details of the change and when it will take effect. The most current version of these terms will always be available on our website, and any updates will apply from the effective date stated in the notice or, if no date is stated, from the date they are published.

These terms are governed by the laws of New South Wales. In the event of any claim or dispute arising out of or in connection with these terms, and any orders placed thereunder, the courts of New South Wales will have exclusive jurisdiction over them.

Shipping

Fast contactless delivery is available to Sydney & Melbourne metro Angels only for orders placed by 3pm. If we experience an unusually large number of orders, we may change the 3pm cut-off to an earlier time so that we can keep our promise to the customers who have already placed their orders. We deliver Australia wide and are continually working on our rates. When a customer purchases online from any state in the country the final price will be based on the wines selected plus the cost of the courier, which will be displayed at the end of the purchase process.

We aim to meet all delivery dates on a best endeavours basis. On the off chance your order goes missing, or we are advised by our courier that it couldn’t be delivered, we will send you a replacement order as soon as we can. If we are unable to dispatch replacement goods within 7 days, we will offer you a full refund. Our courier may require a proof of age identification check if they deem it reasonable at the time they are making the delivery to you or your authorized agent.

If your order is undeliverable we will contact you to arrange for re-delivery. We may charge you a fee for any re-deliveries. Risk of damage, loss or deterioration to the product passes to you upon delivery.

The delivery address you provide at the time of ordering must be located within Australia. We cannot ship internationally. Due to Northern Territory Government legislative changes to the Liquor Amendment Bill, we cannot ship to the Northern Territory. 

Vouchers and Gift Cards

If you're lucky enough to receive a voucher or gift card, here's how they work: Vouchers Our vouchers are for first time customers only (apart from a handful of exceptions) and they can be redeemed online or over the phone.

  1. They cannot be combined with any other offer or promotion (Angel prices for example) and they're one voucher per person (i.e. we can't stack them otherwise we'd be giving too much wine away!).

  2. They're also for one-off purchases only i.e. you're not required to join any type of wine club when redeeming your voucher (although we will invite you to become an Angel!)

  3. Our vouchers typically have a minimum spend associated with them, unless otherwise stated. For example:

  4. $75 off a case worth $134.99 or more (excl. delivery)

  5. $80 off a case worth £119.99 or more (excl. delivery)

  6. BUT please note, the minimum spend does vary from voucher to voucher so please refer to the voucher itself.

  7. Before you get spending, you'll have to register with us first, including email address and credit/debit card details. We'll use your card details to verify your age in addition to taking payment.

  8. Your voucher can be used against the vast majority of cases on our site (we will make it clear if you can't) - as long as it hits the minimum spend. And please see voucher for any expiry date that may apply. We reserve the right to update the offer at any time.

  9. In the unlikely event that your voucher promotes a specific case of wine and you cannot find this on our site, please get in touch with our Customer Happiness Team on 1300 898 677who'll be happy to place the order for you.

Gift Cards For the purposes of these terms and conditions, a 'gift card' is a product that has been pre-purchased for a nominated credit value.

  1. Our gift cards can be redeemed online or over the phone by new or existing customers. They cannot be combined with any other offer (money-off vouchers for example). You're welcome to use your gift card for one-off purchases, and you're not required to join any type of wine club when redeeming it (although we will invite you to become an Angel!)

  2. Before you get spending, you'll have to register with us first, including credit / debit card details (even if you're not spending any of your own money), so we can verify your age, check where to send the wine to - and take any necessary payment for delivery or if you decide to top up your spend.

  3. Your gift card can be used against the vast majority of cases on our site (we will make it clear when redeeming the gift card).

  4. If you want to treat yourself to more than the gift card value (i.e. your wine plus delivery costs comes to more than the value of your gift card), we will charge the outstanding balance to your registered credit / debit card (OR use up any existing Naked Wines account balance if applicable).

  5. If you don't use the full balance of your gift card in the one transaction, the outstanding balance will sit in your Naked Wines account ready for your next order.

  6. Once redeemed, your gift card balance cannot be transferred to other accounts or used to purchase other gift cards.

  7. If you’ve already redeemed your gift card, to remind yourself what your remaining gift card balance is, you can visit your account page - or get in touch with our Customer Happiness team on 1300 898 677.

  8. Gift cards should be treated as cash. Naked Wines cannot accept any liability for lost, stolen or damaged gift cards.

  9. Angel account balance cannot be transferred into Naked Wines Gift Cards, they can only be purchased with a valid debit / credit card.

User Generated Content

If you post a comment on any of the public walls around the site, or provide a product review or rating, your comments will be in the public domain and therefore will be visible to anyone who visits the site. Therefore, please don't say anything embarrassing, nasty or private. Users may access their Naked Me page to update or delete their personal information and change their privacy settings. To do this, simply log into the Naked Me section of the website and edit your profile.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information relevant to the site (“Submissions”), provided by you on the site regarding Naked Wines, its affiliated companies or partners are non-confidential and Naked Wines, its affiliated companies and partners will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to you. Naked Wines neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on the Nakedwines.com website by anyone other than authorized Naked Wines’ employees acting in their official capacities.

Community Guidelines Naked Wines connects everyday wine drinkers with the world’s best independent winemakers. To make sure all of our staff, customers and winemakers have a positive experience interacting on our website, we have Community Guidelines to outline what we do and do not allow on our website.

Keep it respectful, inclusive and friendly: The purpose of our groups and walls is to connect you to one another and to our winemakers - and to have a little fun along the way. We may remove content that violates our guidelines, including comments or media that contains:

  • Hateful activities or language directed at individuals or groups (this includes any negative stereotypes, prejudices or attacks)

  • Irrelevant or non-purposeful material

  • Spam (this includes linking to websites that are unsafe, deceptive, untrustworthy, unoriginal or facilitate spam)

  • Explicit content (this includes content that risks harm to people or animals, including sexual, physical or financial exploitation)

  • Misinformation (this includes content that may harm individual or public safety or trust)

  • Harassment or privacy violations

Respect one another’s privacy: Please don’t post any personal information, photos or videos that you’re not authorised to share. We endeavour to remove any private information that is shared as quickly as possible.

Be proactive: If you do spot a post or comment that breaks our community guidelines, please report it. You can do this by clicking on the little arrow in the top-right hand corner of a post and clicking on the ‘report’ button. If you’d like to discuss anything in more detail, then please get in touch over the phone ((1300 898 677) or via email (chat@nakedwines.com.au), and we’ll do our best to help.

You’ll still be able to see someone's account, posts and comments after you report them. To see less of their content, you can unfollow them. To block messages from other users on your Naked Wines wall, you could make your profile private. Negative and distasteful comments are luckily few and far between - but rest assured we are here to help and step-in if the need arises.

Naked Wines Angels

You become an Angel by agreeing to save at least $40 into your Naked Wines Angel Account ("Angel Account") towards your next order, yours to spend on any wines whenever you want. Your Angel funds are not refundable or redeemable for cash.

In return for your support of the Angel program, you get preferential pricing of up to 50% off of Nakedwines.com's already great prices every time you order (i.e., you pay the Angel Price rather than the normal price listed next to each product).

How Your Angel Account Works. Your first payment will be transferred from your registered credit or debit card when you become an Angel and monthly payments will be transferred from your registered credit or debit card on or around that date each month that you continue being an Angel (you can change your payment date on your Account page).

By signing up to be a Naked Angel — either by purchasing our introductory offer or through other means — you authorize Nakedwines.com to make recurring periodic charges to your card, as described above, without further authorization from you until you cancel your Angel membership.

Your Angel Account balance will be used to make purchases in accordance with a “First-In First-Out” (“FIFO”) method, meaning the first-added or oldest funds will be used first to make any purchases on our site and will be withdrawn first in the event we return some, but not all, of your Angel Account balance to you. If you place an order that totals more than the balance in your Account, then we will charge your registered debit/credit card for the difference.

Every two years, on or around February 28, if your Angel Account reaches a balance of $80 or more and you have not placed a qualifying order during the preceding twenty-four (24) months, we will automatically apply your Angel funds towards the delivery of a curated case of wine to the last-known delivery address on your Angel Account. We will provide advance notice prior to such delivery. During the notice period, you may elect to place a qualifying order, update your delivery preferences, or opt out of the automatic delivery.

If you don't like a wine, or it's corked or damaged, we'll add a credit to your account to try something else. Email us at chat@nakedwines.com.au or call us at 1300 898 677 and we'll sort it out for you.

Promotions, including discount vouchers, are only redeemable against the standard price, not the Angel price, unless otherwise stated. Promotional funds may not be applied towards a monthly Angel payment. There is no Angel discount when buying a gift certificate and Angel funds may not be applied to buying a gift certificate.

A minimum purchase is required to claim your Angel "gift" bottle. Your gift bottle is included in the price of your purchase. The discount attributable to the gift bottle is distributed evenly among all of the wines included in your purchase.

Your participation as a Naked Angel entitles you only to the benefits listed in these Terms and Conditions. You are not entitled to any interest whatsoever in any winery, winemaker, or other enterprise.

Cancelling Your Angel Account. If you cancel your Angel membership or your monthly contributions stop, other than where you have opted for a temporary monthly payment holiday, any unspent Angel funds will expire twenty-four (24) months after the date of cancellation. At the time your membership is cancelled or payments cease, you may choose to apply any unspent Angel funds to place a final order of wine that exhausts the remaining unspent funds.

You may cancel your Angel Account at any time by visiting the Angel Account section of your Account page, calling us at 1300 898 677 or emailing us a chat@nakedwines.com.au. If you cancel your Naked Angel account, you will no longer be entitled to Angel privileges like preferential pricing and other Angel-only offers.

Pre-order cases

We occasionally invite you to pre-order wines that are currently out of stock, or new exciting wines that will be added to our range. We typically ask you to put down a $10 deposit to secure 6 bottles. This will appear just like any regular order would, in your order history. You can pay your deposit using your registered card or any cash in your Naked Wines account (you can’t use vouchers or account credits). When the wine is ready to ship, we’ll email you to let you know and tell you when it’s due and how much balance you owe (which you’ll pay when we ship you the wine).

If you’ve changed your mind, you can cancel your order and we’ll give you your $10 deposit back. Our 100% hassle-free guarantee still applies to pre-ordered wines, so if you don’t enjoy it, or it’s faulty, just let us know and we’ll add a credit to your Naked account. Please note, pre-order delivery dates are estimates and subject to change. If there’s a delay, we’ll let you know by email. Our standard delivery charges apply.

Never Miss Out

To ensure you never miss out on your favourite wine/s again, you can pop your name on the reserve list of a particular wine to guarantee first dibs every time a new vintage lands.

You tell us how many bottles (6 / 12 / 15) and we’ll make sure you're the first to know when a new vintage arrives (which is typically once a year). We'll let you know at the point you pop your name on the list when the wine is roughly due to land each year, but please be mindful that this is an approximate date as the winery and shipping gods change our plans sometimes.

When the wine is on its way to our warehouse, we'll send you an email to let you know it's landing soon (with an approximate delivery date). And unless you tell us not to, we’ll pop your wines in the post so you don’t need to lift a finger. There's absolutely nothing to pay until we send your order over to our warehouse, up to a week before it's shipped.

Please note, we don't offer this service on all of our wines - and if we decide to stop stocking a wine for any reason, we will email you to let you know, and we won't be able to ship you any more of that wine. Equally, if a winemaker has a poor harvest, and yields are down, then we reserve the right to reduce your allocation to share out the spoils - or in very rare cases, we may have to cancel your allocation.

Wine Genie

Wine Genie is a wine subscription service, where we select wine for you based on your preferences and ship it to you on a recurring basis. You can sit back and let us do everything for you, or you can be really specific if you want to.

  1. The sit back route:

    • Pop your name on the Wine Genie list

    • We’ll send you a case of wines to get you started

    • If we know what you enjoy, we’ll customise the wines to your taste…

    • ...if not, we’ll send you some crowd-pleasing customer favourites

    • You drink them (the hard part)

    • And ideally you tell us what you think (with just a couple of clicks)

    • We’ll only bill you for the wines you’ve told us you love (if we offer you ‘Try Before You Buy’ - more on that below)

    • And when you’re running low, we’ll send you your next case to enjoy…

  2. The more specific route:

    • All of the above! But you can hop online and give us more specific instructions:

    • How frequently you want to receive a case (every 1, 2 or 3 months)

    • Whether you want to receive a mixed, all red or all whites case

    • An indication of the kind of price you’re comfortable paying

    • Plus how many bottles you’d like to receive in each case (6, 12 or 14).

We’ll send your wine to your default delivery address, which you can update at any time in your account. There are no tie-ins or contracts, and you can cancel your membership at any time. 

What will my Wine Genie cases cost? When you pop your name down for Wine Genie, we’ll ask you the average amount you typically spend on a bottle: between $8.99 and $10.99, between $11.00 and $15.99, or over $16, and every time you need a top up, we’ll suggest a case we think you’ll love based on these price-points and your personal preferences. If the price of the recommended case is too much (or too little), we can change your case for you.

What’s the delivery charge? Your standard delivery costs apply to Wine Genie cases.

What if I want to change the frequency or size of my cases? As above, you can change the case size, colour, frequency and price-settings of your Wine Genie cases in your account. Or you can drop us a line and we’ll do it for you.

Will I still get all of my Angel perks alongside my Wine Genie cases? If you’re an Angel, you’ll only ever pay Angel prices - both on your Wine Genie cases and any ad-hoc purchases. Plus, you’ll still be offered a Thank You bottle every month (which you’re welcome to claim on non-Wine Genie orders as usual), get first dibs on new releases and keep all your other perks.

Recommending a friend

For the person sending an invite. Every Angel is invited to send a welcome deal to their friends who don't currently shop with Naked Wines, via email, Facebook and Twitter. This deal may vary, but you can find the details via the 'Invite a friend' link in the menu once logged-in.

You can send the deal to as many friends as you like, as often as you like, but your friends will only be able to redeem the deal if they're new to Naked Wines. By inviting a friend, you confirm that you have their consent for us to email them their offer code, plus one reminder. They have 30 days to claim - after that, we’ll delete their data. If your friend decides to take up the deal, they're under no obligation to buy again or become an Angel (but we will invite them to become one!). For every friend that orders off the back of your invite, we will credit your Naked Wines account with credit as soon as their order is shipped. The credit is not refundable and expires twenty-four months after the date of issuance. Void where prohibited. Additional restrictions apply and vary by state. This offer cannot be sent or redeemed in the Northern Territory.

Naked Wines reserves the right to withdraw or revoke the credit offer or change the amount of the credit at any time, if it determines that the 'Invite a friend' deal is being abused or it is appropriate to do so.

For the person receiving an invite. If you're new to Naked Wines, you're welcome to redeem any 'Invite a friend' deal sent to you by an existing Naked Wines customer. The offer can only be redeemed one-time. If you have been invited, we'll send you an email with an offer, and one further email reminder. If you don't claim the offer, we'll remove your information from our database after 30 days. The offer cannot be used in conjunction with any other offer or voucher. If you do decide to order and you don't like the wines, our hassle-free guarantee still applies - just let us know and we'll add a credit for the price paid to your account for you to put towards another order.

SMS Alerts

By providing your phone number to Naked Wines through the site or app, you consent to receive calls or text messages, including calls or text messages sent through automatic telephone dialing systems and pre-recorded calls at any telephone number that you have provided us, in order for us to: (i) notify you about your account; (ii) provide you updates on the status of your order and/or delivery; (iii) collect an outstanding payment or debt; and (iv) contact you about exclusive offers and for any other marketing or promotional purposes.

If you elect to receive text messages or phone calls from us via our site, app, by sending a text message to us indicating your consent, or otherwise, you are providing your prior express written consent to receive recurring marketing or promotional telephone calls and/or SMS text messages from us at the phone number used when signing up, including your consent to marketing messages and calls sent through an automatic telephone dialing system. This service is optional and is not a condition of purchase. Message frequency varies.  Information on how we collect, use and protect your data is available in our Privacy Policy.

Naked Wines is not responsible for any SMS messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number. Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. Naked Wines, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

Cancellation

You may opt out at any time by contacting us at chat@nakedwines.com.au or 1300 898 677. You may also text the keyword STOP, END, CANCEL, UNSUBSCRIBE or QUIT to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode or phone number you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that Naked Wines and its service providers will have no liability for failing to honor such requests.

Limitation of Liability

Your use of the website is at your own risk and you assume full responsibility for all costs associated with all necessary servicing or repair of any equipment you use in connection with your use of the website. Naked Wines and its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the website. In no event shall Naked Wines and/or its suppliers be liable for any indirect, punitive, incidental, special or consequential damages, or any damages whatsoever, including, without limitation, damages for:

  • loss of use, data or profits, arising out of or in any way connected with the Nakedwines.com website;

  • the use or performance of the Nakedwines.com website;

  • the delay or inability to use the Nakedwines.com website;

  • the provision of or failure to provide services;

  • any events, information, software, products, services or related graphics obtained through the Nakedwines.com website; or

  • any claim otherwise arising out of the use of the Nakedwines.com website

whether based on contract, tort, negligence, strict liability or otherwise, even if Nakedwines.com or any of its suppliers has been advised of the possibility of damages. If you are dissatisfied with any portion of the website, or with any of these Terms and Conditions, your sole and exclusive remedy is to discontinue using the website. This sole and exclusive remedy is separate and independent of any other provision that limits Naked Wines’ liability or your remedies.

Naked Wines shall be excused from performance under these Terms and Conditions if Naked Wines is prevented, forbidden or delayed from performing, or omits to perform, any act or requirement by reason of: (a) any provision of any present or future law or regulation or order of Australia, or any state thereof, (b) any act or omission of a third party, or (c) any act of God, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of Naked Wines.
